General Terms and Conditions (GTC) – kanuladen24.de

1. Scope
These GTC apply to all orders placed via our online shop.

2. Contracting party, conclusion of contract
The purchase contract is concluded with Kanuladen24.de GbR, Friedrich-Naumann-Straße 5, 71636 Ludwigsburg, Germany (“we/us”). Further contact details and the shop/returns address can be found in our imprint.

Product listings in the online shop do not constitute a legally binding offer but an invitation to place an order. You can place products in the cart without obligation and correct your entries at any time before submitting the order. By clicking the order button, you submit a binding order for the goods in the cart.

We will confirm receipt of your order by email immediately after submission (acknowledgement). A contract is concluded once we accept your order, e.g. by sending an order confirmation in text form or by dispatching/handing over the goods.

Exception for PayPal payments (including PayPal services offered in checkout, e.g. credit card via PayPal or invoice via PayPal):
The contract is concluded upon completion of the PayPal payment process / confirmation of the payment instruction.

3. Contract language, storage of contract text
Contract languages are German and English. In case of discrepancies, the German version shall prevail.

We store the contract text and will send you the order data and these GTC by email. If you have created a customer account, you can view your orders there.

4. Delivery, shipping, collection
In addition to the stated product prices, shipping costs may apply. Details on delivery areas, shipping methods, delivery times and shipping costs are provided under “Shipping & Payment” and during checkout.

We deliver by shipment (parcel service/forwarding agent). Where offered during checkout, “collection in shop” is available. We will inform you when the goods are ready for collection; collection takes place during the stated opening hours or by appointment.

5. Payment
Depending on your cart, delivery country and checkout display, the following payment methods are available in particular:

  • PayPal

  • PayPal Express

  • Credit card (via PayPal)

  • Invoice purchase (via PayPal)

  • Payment on collection in shop (where offered)

For PayPal payment methods you will be redirected to PayPal’s website. PayPal’s terms of use and privacy notices apply in addition.

For payment on collection, the purchase price is due upon handover/collection unless stated otherwise during checkout.

6. Retention of title
Goods remain our property until full payment has been made.

7. Transport damage
If goods are delivered with obvious transport damage, please report this to the carrier immediately and contact us without delay. Failure to do so does not affect your statutory rights, but it helps us assert claims against the carrier/insurer.

8. Statutory warranty and guarantees
Statutory warranty rights apply unless expressly agreed otherwise below. For used goods, the limitation period for warranty claims is one year from delivery. This does not apply to claims resulting from injury to life, body or health, intentional/grossly negligent breach of duty, fraudulent intent, breach of essential contractual obligations, agreed guarantees, or claims under the Product Liability Act. Any additional guarantee terms are provided on the respective product pages.

9. Liability
We are liable without limitation for damages resulting from injury to life, body or health, intent or gross negligence, agreed guarantees, or under the Product Liability Act. In case of slight negligence of essential contractual obligations, liability is limited to the foreseeable, typical damage at the time the contract was concluded. Otherwise, liability for damages is excluded.

10. Consumer dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Final provisions
German law applies excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive the consumer of mandatory protections of the country of habitual residence. If the customer is a merchant/public entity, the place of jurisdiction is our registered office.
